i have been lead to believe that beethoven did not write the "ode" theme..is this true?

No - Beethoven wrote the theme. However similarities between melodies are inevitable when you consider the basic building blocks of the tonal system - scales and arpeggios. Beethoven's theme is based on a scale pattern and the first seven notes are identical (different key and rhythm) to the 2nd theme of Bach's 'Jesu Joy of Man's desiring'.
